BREAKING: MEC challenges Blantyre relication

The Malawi Electoral Commission has announced that it will not relocate to Blantyre as instructed by President Peter Mutharika.

A statement released by the MEC indicates that the commission has referred the issue to the high court for examination.”

Upon reviewing the legal framework that establishes the Commission, particularly section 76 (4) of the Constitution of the Republic of Malawi and Section 6 (1) of the Malawi Electoral Commission Act, the Commission has submitted an application to the High Court requesting a judicial review of the Order, as it relates to the Commission,” the statement states.

It further notes: “Through this application, the Commission seeks a clear determination from the Court on whether the order to move its Head Office constitutes unlawful interference with its constitutional and statutory powers, functions, and responsibilities.

Additionally, the Commission is requesting an interim measure to ensure that, while the judicial review is ongoing, it will continue to operate from its current location in Lilongwe.
