Court nullifies appointment of Nurses Council CEO

The High Court in Blantyre has nullified the appointment of Dr. Chrissy Kamwachale as the Registrar and Chief Executive Officer of the Nurses and Midwives Council of Malawi (NMCM) by the Office of the President and Cabinet (OPC).

The National Organization of Nurses and Midwives in Malawi (NONM) and the Association of Malawian Midwives raised objections to Dr. Kamwachale’s appointment and subsequently brought the issue to court.

In a ruling delivered Judge Edna Bodole stated that Dr. Kamwachale’s appointment, as indicated in the appointment letter dated April 30, 2026, was null, void, and lacked any legal standing, having been made unlawfully and without proper authority.

The ruling indicates that Dr. Kamwachale does not fulfill the statutory qualifications necessary for the position of Registrar and CEO of NMCM as outlined in the Nurses and Midwives Act.

Counsel Mauya Msuku, who represented NONM and AMAMI in this case, remarked that the appointment was procedurally unjust and unreasonable, expressing that his clients are very pleased with the court’s decision. There has been no immediate response from the OPC regarding the ruling.
