Infamous Suleman case earns lifeline
The High Court of Malawi has referred a judicial review case filed by concerned citizen Austin Mkoka against Speaker of the National Assembly Sameer Suleman to Chief Justice Rizine Mzikamanda for certification as a constitutional matter.
The referral follows sworn statements by Attorney General Frank Mbeta, the second interested party in the case, according to court documents.
Judge Allan Mhome has suspended proceedings pending the Chief Justice’s decision on whether the matter qualifies for constitutional certification.
If certified, the case will remain suspended until it is heard and determined by a panel of High Court judges constituted under the relevant constitutional provision.
Mkoka is challenging the legality of the Speaker’s decision to establish 12 joint parliamentary committees to investigate alleged corruption and governance failures in public institutions.
